I’m not just a parental rights lawyer – I’m also a single father. I know that one of the most frustrating situations a parent can find themselves in is being denied parenting time with a child of whom you are legally responsible. Regardless of whether you are or were married, if you have a child, you have certain rights with regard to being a parent to that child. Interestingly, you may be awarded parental rights even if you are not the biological father (parent?). The only thing a Court can enforce is a Court’s order. So it is often imperative that all interested parties petition the Court for orders allocating parental rights to all interested parties. However, a Court’s determination is based upon the best interest of the child, and not necessarily upon simply what the parties or even the child wants. It is critical that a child visitation attorney get the proper information in front of the Court so that it may issue orders that are in the child’s best interest.
